Having RTI in place alone does not serve as deterrent to corruption. The mindset of the people in position must change and they should truly believe in serving the Tsa Wa Sum from the bottom of their heart. Meaning, we should walk the talk and not the other way around. This is the only way to fulfill the noble aspirations of His Majesty the King. Then only having RTI or ACC will make any difference. For all purposes, if this were true, then, with the formation of ACC to combat corruption in the Kingdom, corruption levels should have fallen dramatically, however, the latest report released by the RAA tells us the exact opposite, that corruption is still very rampant.<br /><br />So while RTI may aid to a certain extent in the fight against crime, what is needed more, are laws and penalties that are more severe to deter people from indulging or even thinking about indulging in corruption. The problem we face in Bhutan, however, is that many people are above the law and hence implementing any laws credibly is next to impossible. I am sure ACC must have been railroaded many times when confronted by such a situation. I even believe that the ACC were somehow coerced to prosecute the Gyelposhing case even after the AGs offices had declared that they had no legal basis to prosecute the case. This should be thoroughly be debated in Parliament, but prior to the debate, a nationwide in-depth survey should be done. If we must have one then debate why we need and what are the real benefits. When a single "controversial" project like Bhutan Education City begs an Act, I think it's timely for us go for the RTI Act. We are a small society; enforcement should not come on the way. To me what is most critical and urgent is to revisit some of the existing laws and make some amendments so that it serves the purpose. Take the example of Lam Sonam Tshering's tobacco case and Arjun Giri's imprisonment by Sibsu Dungkhag court. If there was no intervention from His Majesty the King the poor fellow would be still in jail. Therefore, thorough deliberations on some of the existing laws seem imperitive so that innocent people do not suffer unnecessarily. If similar incidents continue to take place the outside world will be laughing at us and make fun of GNH concept.Anonymousnoreply@blogger.com
